Terms of Use

These Terms of Use (the "Terms") are an agreement between you and Fengjuan Liu ("we", "us" or the "Developer") about your use of the Android app TCG Scanner: Card Price Check (the "App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.

1. The App

The App helps you identify trading cards from photos, look up reference market prices, estimate a card's condition and keep track of your collection. We may add, change or remove features over time.

2. Recognition, condition and prices are for reference only

• Card recognition and condition estimates are produced automatically by AI and can be wrong. Please check the card, its version and its condition yourself before you buy, sell or trade.
• Condition estimates are not professional grading, and the App is not affiliated with any grading company.
• Prices are reference values based on third-party market data. They may be delayed, incomplete or different from what a card actually sells for. They are not an offer to buy or sell, an appraisal, or financial or investment advice.
• You are responsible for the decisions you make based on information in the App.

3. Free plan and Pro subscription

• Free plan. The free plan includes a limited number of scans per day, as shown in the App.
• Pro. Pro is an auto-renewing subscription, billed monthly or yearly, that gives you the features described in the App. It is bought through Google Play and charged to your Google Play account. The price is shown in the App before you buy, in your local currency, and may include taxes.
• Free trial. If a free trial is offered, you won't be charged during the trial. Unless you cancel at least 24 hours before the trial ends, the subscription begins and you are charged when the trial ends. Google Play decides who is eligible for a trial, usually once per account.
• Automatic renewal. Your subscription renews automatically at the end of each period at the price then in effect, unless auto-renew is turned off at least 24 hours before the end of the current period.
• Managing and canceling. You can manage or cancel your subscription at any time in Google Play account settings. Canceling stops future renewals; you keep Pro until the end of the period you have paid for. Uninstalling the App doesn't cancel your subscription.
• Refunds. Payments are handled by Google Play, and refunds follow the Google Play refund policy. Except where the law requires otherwise, we don't give refunds or credits for partly used periods.
• Price changes. If the price of Pro changes, Google Play will tell you in advance as its rules require, and you can cancel before the new price applies.
• Restoring purchases. Pro is tied to the Google account you bought it with. Tap "Restore" on the App's Pro page to restore it on another device signed in to the same account.

4. Your photos

You keep all rights to the photos you take. You allow us to send them to our server and our AI provider and to process them only to provide the App, such as recognizing cards and estimating their condition, as described in the Privacy Policy. Please scan only photos you have the right to use, and avoid including people or personal information in them.

5. Acceptable use

You agree not to:

• use the App for anything illegal or to infringe anyone's rights;
• copy, modify, distribute, sell or rent the App, or reverse engineer or decompile it, except where the law allows;
• access our server other than through the App, send automated requests, scrape the card database or prices, or get around usage limits or subscription checks;
• interfere with or disrupt the App or its servers, or upload anything harmful.

We may limit or suspend access to the service for anyone who breaks these rules.

6. Intellectual property

The App, including its design, code and text (other than third-party content), belongs to the Developer. Card names, card images, symbols, game names and related trademarks belong to their owners, including The Pokémon Company, Nintendo, Creatures and GAME FREAK (Pokémon), Wizards of the Coast (Magic: The Gathering), Konami (Yu-Gi-Oh!), Bandai (One Piece Card Game), and Disney and Ravensburger (Disney Lorcana). TCG Scanner: Card Price Check is an independent app. It is not produced, endorsed, sponsored or approved by any of them, or by TCGplayer or any other price data provider.

7. Third-party services

The App relies on services run by others, such as Google Play for subscriptions and third-party providers for price data, and may link to websites such as TCGplayer. Your use of those services is also subject to their own terms, and we're not responsible for them.

8. Disclaimer

The App is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that the App will be uninterrupted or error-free, or that recognition results, condition estimates or prices will be accurate or complete.

9. Limitation of liability

To the fullest extent the law allows, the Developer is not liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or trading value, arising from your use of or inability to use the App. Our total liability for any claim is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits any liability that cannot be limited by law.

10. Ending your use

You can stop using the App at any time by uninstalling it; to stop paying, also cancel your subscription in Google Play. We may suspend or end your access if you break these Terms, and we may stop offering the App or some features. If we stop offering Pro, we'll try to tell you in advance.

11. Changes to these Terms

We may update these Terms from time to time. We'll post the new version on this page and update the "Last updated" date, and for significant changes we'll also let you know in the App when possible. If you keep using the App after a change takes effect, you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. If a dispute arises, please contact us first so we can try to resolve it.
